A Few Updates on an Older Post

This post to serve as an update on a post that is over 10 years old. The Rifleman has a strong memory (from time to time). On that post, a reader asked, "Any word? How did the remand hearing go?"

For reasons that are not pertinent to this post, the Rifleman did not neglect to answer this question, but instead, postponed the answer until a more appropriate time. This time has come. 

In the remand, it is important to first state a particular fact: The judge that issued the ruling, Tom Gray, retired shortly after his errant ruling. As a matter of fact, four of his last five rulings (the author's brother's ruling being one of these) were overturned in appellate courts. Divorce ruling appeal successful. In a move that still strikes this author as exceptionally odd, Gray requested to be the judge on the remand hearing. Brother's lawyer argued that it is extremely peculiar to allow a civilian to hear a divorce remand, and the Sumner county Court agreed, and the sitting judge, Judge Oliver, whom had replaced Gray, heard the remand. 

The remand basically restored Alimony and Child support amounts to the pre-trial amounts. Visitation was also restored to the pre trial amount. Interestingly enough, Dependopotamus remarried on December 14, 2014. This, to an individual who resided in another state (state name withheld on purpose). Dependopotamus had visited that state numerous times in the final year of the marriage, and during the separation period.

So you KNOW what was happening. 

Because this author stalked Facebook accounts, the picture of the marriage license was discovered and passed along to Brother and his attorney. Alimony was dropped after December 2014. 

There were a couple of clarification appearances in court. Judge Oliver was much more level on his rulings. Finally, Brother's lawyer (upon receipt of a 3rd request to go to court to hash out something else) basically threatened legal action against Dependopotamus' lawyer, possibly including moving to get him removed from the bar.  The action was dropped, and there have been no requests for court action since. Further, Judge Oliver reportedly was getting fed up with Dependopotamus' act in court and refusal to get a job, and became less open to giving her what she asked for. Now, it is possible, since this author heard of these accounts second-hand, and because of a 10-year lapse in time, that the events in this paragraph are factually inaccurate. And if so, please advise with proof, and this author will gladly correct the paragraph. 

Even furthermore, it is fact from the documents listed that Dependopotamus' parents were paying for attorney fees. It is speculated that they either became unable or unwilling to fund more court appearances. 

Nevertheless, there has not been any substantial change in visitation or child support in that time. 

It recently became known that Dependopotamus made a social media post about getting a job. Mind you, she had held positions prior to that, but had never sent tax records showing this employment to Brother or his attorney (as is required by the courts). Why is this important, you ask?

Because May of 2026 will be the final child support payment. 

Dependopotamus knows this. Brother knows this. She likely does not have the funds. to ask the court for a rare exception to the end of child support. 


Summary
- Alimony ended as of January 2015, due to Dependopotamus getting remarried. 
- Child support was reverted. Has not changed since. 
- Visitation was reverted. Has not changed since. 
- Child support ends with the May 2026 payment. 
- Dependopotamus got a job, presumably because child support is going to end. 
- Brother has vowed to never get remarried, as he believes there is no benefit to this strangely enforced financial contract. He is right.
